The High Court of Cassation and Justice admitted the preliminary reference from the Court of Appeal Bacău and established the mandatory legal interpretation that the right to vacation vouchers is contingent upon the specific budgetary allocations for this purpose in the state or local budgets of public institutions. This decision resolved a conflict regarding the obligatoriness of such benefits for public sector employees, determining that payment is not an absolute entitlement but strictly conditional on fiscal availability. The court based this ruling on the interpretation of Article 1(2) of Emergency Government Order No. 8/2009 (as amended), in relation to Articles 15(2) of Emergency Government Order No. 80/2010, Article 9 of Emergency Government Order No. 84/2012, and Article 5(2) of Government Order No. 29/2013, thereby clarifying that statutory budget constraints take precedence over claims for unpaid vouchers.
