Binding clarification that non-salary professional incomes from civil code contracts denote dependent activities, distinct from independent professional incomes.
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the connected preliminary questions of law submitted by the Court of Appeal of Suceava and issued a binding decision clarifying the interpretation of pension legislation. The dispute concerned the calculation of social insurance contributions for "professional incomes," requiring a distinction between dependent and independent professional activities under the unitary public pension system. The court held that the phrase "non-salary professional incomes from contracts/conventions concluded in accordance with the Civil Code" refers to dependent professional activities based on civil law contracts, whereas the phrase "incomes from professional activities" refers to independent professional activities defined by the criteria in the Fiscal Code (specifically Art. 7 para. (1) point 4 of Law No. 571/2003 for 2011–2015 and Art. 7 point 3 of Law No. 227/2015 from 2016 onward), thereby establishing the legal basis for determining which income sources are subject to social insurance contributions under Law No. 263/2010.
