The High Court of Cassation and Justice admitted the referral from the Bucharest Court of Appeal and issued a binding uniform interpretation, establishing that a procedural act transmitted via fax or email in the final day of a calendar-day deadline, after the court's working hours have ended, is not considered filed within the deadline. The dispute concerned the legal interpretation of deadline computation and the validity of late-filed acts in civil proceedings, specifically addressing whether electronic transmissions sent after the daily cutoff are deemed timely. The decisive legal basis is found in Articles 182 and 183 of the Code of Civil Procedure, which govern the calculation of deadlines and the effects of acts filed within or outside those periods, resulting in a ruling that clarifies the strict cutoff for electronic submissions.
