The High Court of Cassation and Justice dismissed as inadmissible a referral by the Dolj Tribunal seeking a preliminary ruling on whether an action to declare ownership of a building by artificial accession (art. 492 of the 1864 Civil Code, now art. 577) is conditioned on the claimant having obtained a building permit under Law No. 50/1991. The court did not rule on the merits of that legal question, so no substantive resolution was issued; the dismissal leaves the prior proceedings in the referring case to continue without the requested interpretive guidance. The referral was brought under the preliminary-ruling procedure for questions of law (arts. 519–521 of the Civil Procedure Code), and the High Court held that the conditions for admissibility of such a referral were not met, as the question raised did not properly fall within the scope of that procedure.
