The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Court of Appeal of Timișoara regarding the criminal procedure code. The dispute concerned whether the witness's right not to accuse themselves under Article 118 of the Code of Criminal Procedure, combined with the prohibition against using illegally obtained evidence under Article 102(2), mandates the automatic and effective exclusion of such evidence from the case file, or if a specific express order by the preliminary chamber judge is required for its exclusion. The decision resolved the procedural admissibility of the referential question without addressing the substantive interpretation of the evidentiary exclusion mechanism.
