The High Court of Cassation and Justice rejected as inadmissible the preliminary reference filed by the Bucharest Court of Appeal to settle a legal question, leaving the matter unresolved by this specific high-level pronouncement. The dispute concerned the interpretation of Law No. 448/2006 regarding the protection and promotion of rights for persons with disabilities, specifically challenging the scope of financed expenses for special and special-integrated education and whether local public administration authorities could offset these costs against one another. The decisive procedural basis for the rejection was the inapplicability or failure of requirements for such references under Article 521(3) of the Civil Procedure Code, which governs the submission of questions of law for uniform case law.
