The High Court of Cassation and Justice dismissed the request for a preliminary ruling as inadmissible, leaving the procedural posture of the originating case unchanged. The dispute arose from a civil matter where the Tribunal of Bucharest sought clarification on whether a civil judge possesses the prerogative to suspend proceedings under Article 413(1)(2) of the Code of Civil Procedure when criminal proceedings have been initiated solely regarding the specific fact of the civil claim, rather than the entire case. The Court’s decision relied on the procedural admissibility requirements under Article 521(3) of the Code of Civil Procedure, which governs the validity of referrals to the Plenary for resolving matters of law.
