Authentic form requirement for preliminary sale agreements of immovable property
Legislator summary
AI generatedThe High Court of Cassation and Justice (ICCJ), sitting as the panel for resolving issues of law, admitted a request for a preliminary ruling submitted by the Alba County Civil Tribunal and established the binding legal interpretation without resolving specific claims between parties. The dispute concerned whether the authentic form (notarization) was mandatory for the execution of a preliminary contract of sale for an immovable property, specifically in the context of issuing a judicial decision intended to serve in lieu of an authentic act. Relying on the interpretation of Civil Code Articles 1.279(3), first sentence, and 1.669(1), in conjunction with Civil Procedure Code Article 521(3), the court ruled that the authentic form is not obligatory for such preliminary agreements, thereby permitting the use of a judicial decision as a substitute for an authentic document.
