The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Călăraşi County Court, thereby upholding the lower court's procedural handling of the matter without resolving the substantive issue. The dispute concerned a civil action for usucapion (acquisitive prescription) over an unregistered urban property, specifically challenging whether the passive procedural standing belonged to the Administrative-Territorial Unit on whose territory the property is located, given that the possession commenced before the entry into force of the new Civil Code. The legal basis for the dismissal relied on the procedural requirements for raising questions of law under the Civil Procedure Code, where the court found the petition non-compliant with the admissibility criteria for such referrals.
