The High Court of Cassation and Justice, in its Complete Court for Resolving Legal Issues, issued a binding decision in favor of the referring appellate court, establishing that for post-execution recidivism, the first element is the penalty resulting from the cumulative combination of sentences. The dispute concerned whether, under Article 41(1) of the new Penal Code, the calculation of post-execution recidivism requires using the single penalty obtained by cumulating multiple prior convictions under Article 83 of the former 1969 Penal Code (as referenced by Article 96 in relation to Article 43 of the new Code) or instead considering the individual component penalties for each offense separately. Relying on the interpretation of transitional provisions and the nature of cumulative sentencing, the court held that the cumulative penalty must be treated as the effective first term of recidivism, mandating this interpretation for all future applications of the relevant statutes.

Post-execution recidivism requires the cumulative penalty from multiple convictions, not individual component sentences: În aplicarea dispoziţiilor art.41 alin.1 din Codul penal, la stabilirea stării de recidivă postexecutorie se are în vedere, ca prim termen al recidivei, pedeapsa stabilită prin cumul, potrivit art.83 din Codul penal anterior (art.96 raportat la art.43 din Codul penal).
