The High Court of Cassation and Justice dismissed the request for a preliminary ruling filed by the Pitești Court of Appeal as inadmissible, thereby resolving the procedural referral without establishing a uniform interpretation of the legal question. The dispute centered on the application of Article II(4) of Law No. 124/2015 (approving Emergency Government Ordinance No. 92/2014), specifically concerning an economic agent that had paid an authorization tax prior to the statutory deadlines established by Article 14(2)(b)(v)(B) of Emergency Government Ordinance No. 77/2009 and before the entry into force of the aforementioned fiscal-budgetary measures. The court's decision rested on the procedural requirement for the admissibility of preliminary rulings under Article 521(3) of the Code of Civil Procedure, which mandates that such requests must meet specific criteria for the Supreme Court to intervene in the interpretation of domestic law.
