The High Court of Cassation and Justice dismissed as inadmissible a request for a preliminary ruling to resolve a legal question, thereby leaving the procedural status quo of the pending civil case undisturbed. The dispute involved a civil recovery claim against third-party beneficiaries for funds allegedly misallocated through an individual administrative act of a local public administration entity, which had been deemed illegal under administrative litigation law, with the central issue being whether the recovery measure imposed by the Court of Auditors permits such claims. The court analyzed the interplay between Articles 5(5), 33(3), and 64 of Law No. 94/1992 concerning the organization and functioning of the Court of Auditors and Articles 1635 et seq. of the Civil Code regarding recourse against third parties.
