The Romanian High Court of Cassation and Justice (Administrative and Fiscal Section) dismissed the appeal filed by the County Pension House, upholding the lower court's judgment in favor of the claimant, who sought recognition of refugee status for the period from 12 November 1944 to 6 March 1945. The lower court had annulled the pension authority's decision and ordered the issuance of a new decision recognizing that the claimant, born during her parents' displacement, had the same status as her parents. The dispute concerned the interpretation of Government Ordinance No. 105/1999, approved by Law No. 189/2000, which grants benefits to Romanian citizens who suffered ethnic persecution between 6 September 1940 and 6 March 1945, including those forcibly relocated to another locality, and the implementing rules (Government Decision No. 127/2000) assimilating refugees and expellees to such persons. The court held that ethnic persecution based on displacement lasts for the entire period of relocation, so a child born in the locality where the parents were displaced shares their status from birth until the restoration of Romanian territory, and the appellant's argument that the claimant was not yet born at the time of the parents' displacement constituted an impermissible addition to the law.

Asupra recursului de față;
