The High Court of Cassation and Justice of Romania, in a complete panel for legal questions, issued a mandatory binding ruling that the act of a public official fulfilling duties or participating in a decision that directly or indirectly generated patrimonial gain for a person with whom the official had commercial relations is decriminalized by Constitutional Court Decision No. 603/2015, regardless of when the act or the commercial relations occurred. The dispute concerned the interpretation of Article 2531 of the 1969 Penal Code and whether the unconstitutionality of the "commercial relations" phrase in Article 301(1) of the Penal Code applied to cases where both the official's act and the commercial ties predated the entry into force of Law No. 71/2011, which removed the legal definition of commercial relations from the Civil Code framework. The decisive legal basis was the finding that the prior unconstitutionality determination of the term "commercial relations" effectively decriminalized such conduct entirely, nullifying the distinction between acts and relationships predating October 1, 2011, and postdating it.
