The High Court of Cassation and Justice dismissed as inadmissible a reference for a preliminary ruling submitted by the Oradea Court of Appeal, leaving the procedural decision of the referring court intact. The dispute concerned the interpretation of Government Emergency Ordinance No. 8/2009 regarding vacation vouchers, specifically whether the beneficiary category under Article 1(2) was limited to contractual employees or also extended to civil servants and civil servants with special status, and whether the 2015 amendments clarified this inclusion. The Court rejected the request without addressing the substantive legal questions, basing its decision on procedural inadmissibility under Article 521(3) of the Code of Civil Procedure, which governs the admissibility of preliminary references.
