The Supreme Court of Romania (Inalta Curte de Casatie si Justitie) issued a binding legal interpretation in response to a submission from the Constana Tribunal, establishing that the issuance of an enforcement clause for a promissory note occurs within the approval procedure for forced execution rather than as a separate prior step. This decision resolved a procedural dispute concerning the specific mechanics of enforcing promissory notes under the new Civil Procedure Code, determining that the act of *invescirea cu formula executorie* is integrated into the judicial approval process. The ruling is based on a unified interpretation of Article VII of Emergency Government Ordinance No. 1/2016, read in conjunction with Articles 640 and 666 of the Civil Procedure Code, which govern the initiation and approval of execution measures.
