In a decision mandated by the Inter-State Court of Justice and Justice, the High Court of Cassation and Justice admitted the preliminary ruling request from the Bucharest Court of Appeal and established that the contractual representation of legal persons before courts may be ensured by an in-house legal counsel who also holds the qualification of an industrial property consultant. This ruling resolves a dispute concerning the scope of the Ordonance No. 66/2000 regarding the organization and practice of the industrial property consulting profession, specifically interpreting Article 28(2) in conjunction with Article 20(1) to determine whether such dual-qualified in-house personnel possess the standing to represent entities in judicial proceedings. The interpretation is mandatory for all lower courts pursuant to Article 521(3) of the Code of Civil Procedure.
