The High Court of Cassation and Justice ruled in favor of the referring court's legal interpretation, establishing that the aggravated form of the crime of taking bribes under Article 7, paragraph 1 of Law No. 78/2000 (applicable prior to 2014) is strictly conditioned on the offense being committed in connection with the perpetrator's official duties to establish or sanction contraventions. The dispute arose from a request for preliminary ruling submitted by the Constanța Court of Appeal, which sought clarification on whether it sufficed for the accused to merely possess such duties or if the bribery act had to be directly linked to the exercise of those specific powers. The Court determined that the aggravated provision applies only when the bribe-taking is committed in relation to the official functions concerning the establishment or sanctioning of contraventions, rejecting a broader interpretation that would apply solely based on the holding of such a position. This decision is binding from the date of its publication in the Official Monitor and serves as the definitive legal basis for filtering cases involving this specific aggravating circumstance in corruption matters.
