Admissibility of preliminary ruling on evidentiary standards for psychoactive substances under Law 194/2011
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the referral for a preliminary ruling submitted by the Alba Iulia Court of Appeal, leaving the lower court to resolve the dispute without a binding interpretation from the Supreme level. The case involved a criminal prosecution concerning the objective element of the offense defined in Article 16 of Law No. 194/2011, specifically regarding the production or trafficking of substances susceptible to having psychoactive effects. The referring court sought clarification on whether consulting Council Decision 2005/387/JHA and EMCDDA/Europol reports was sufficient to establish the psychoactive nature of a product, given the law's lack of explicit reference to these documents, and whether adherence to the authorization procedures under Articles 6 and 7 of Law No. 194/2011 was mandatory for this determination. The Supreme Court did not address the merits of these substantive legal questions regarding the definition of psychoactive substances or procedural requirements in Law No. 194/2011, instead focusing solely on the procedural inadmissibility of the request for a preliminary ruling.
