Request for change of venue declined for lack of jurisdiction, with competence transferred to the Court of Appeal Bucharest
Legislator summary
AI generatedThe High Court of Cassation and Justice declared itself incompetent and transferred jurisdiction over the request for a change of venue to the Bucharest Court of Appeal, noting that the decision is final and unappealable. The dispute concerned a procedural motion to remove a civil case registered in March 2013 from the Giurgiu Tribunal to another court, alleging legitimate suspicion. The decisive legal basis was Article 142(1) of the New Code of Civil Procedure, which mandates that requests for a change of venue based on legitimate suspicion against a first-instance court must be adjudicated by the appellate court of the respective jurisdiction, thereby rendering the Court of Appeal Bucharest the competent authority.
