The High Court of Cassation and Justice (ICCJ) adjudicated a preliminary reference under Article 521 of the Code of Civil Procedure, ruling that in cases where a property restituent alienated their rights and the original land restitute request remained unsolved by title issuance or compensation before the entry into force of Law No. 165/2013, the assignee (cesioner) holds the exclusive right to the reparative measure of compensation via points under Article 24(2)-(4) of that Law. The dispute concerned the interpretation of Law No. 165/2013 on the finalization of restitutions of property abnormally taken during the communist regime, specifically determining which party—the original right-holder, their heirs, or the subsequent purchaser—is entitled to repair damages when the administrative process stalled prior to the new law’s enactment. The decisive legal basis rests on Articles 1(3) and 4 of Law No. 165/2013, read in conjunction with Article 1(1) and 3(6) of the same Act, Article 27(1) of the Land Fund Law No. 18/1991, and Article 1 of Protocol No. 1 to the European Convention on Human Rights, establishing the assignee's status as the sole entitled party for point-based compensation.
