Application of Law 165/2013 restitution measures to pre-2013 compensation titles lacking administrative monetization procedures under Law 247/2005
Legislator summary
AI generatedThe High Court of Cassation and Justice, acting as the panel for resolving legal issues, admitted a preliminary reference from the Court of Appeal of Constanța and ruled in favor of the applicants by establishing that the provisions of Article 41(1) of Law No. 165/2013 are inapplicable to entitled persons or their authors who obtained compensation titles from the Central Commission for Determining Compensations before Law No. 165/2013 entered into force, failed to follow the administrative procedure under Chapter V1, Section 1, Title VII of Law No. 247/2005, and missed the deadlines for monetizing said titles. The dispute concerned the validity and restitution rights of individuals whose claims were pre-existing under the old compensation framework, specifically challenging whether the procedural non-compliance regarding the new law’s administrative steps barred them from accessing its substantive protections. The decisive legal basis is the exclusion of Law No. 165/2013’s application to pre-2013 compensation titles where the mandatory administrative procedures and deadlines of Law No. 247/2005 were not observed.
