The High Court of Cassation and Justice, acting as a body for resolving legal questions, admitted connected references from the Court of Appeal and issued a binding interpretation stating that the condition of having a registered domicile in the locality where land is allocated can be fulfilled after the issuance of the title deed; consequently, failure to meet this requirement does not invalidate the allocation but triggers the specific sanction provided by law. The case involved a legal question regarding the application of the Land Fund Law to determine the consequences of non-compliance with domicile requirements in land allocation proceedings. The decisive legal basis comprises Article 21(2) and Article 49 of Land Fund Law No. 18/1991 (as republished and amended), which together establish that post-issuance domicile fulfillment is permissible and that only the specific sanction in Article 49 applies for non-compliance.
