The High Court of Cassation and Justice, acting as the Complete Court for Deciding Questions of Law, admitted the preliminary question raised by the Court of Appeal and ruled that the exception of illegality of an individual administrative act may be invoked directly in appeal. This decision resolves a procedural dispute regarding the admissibility of raising such an exception for the first time at the appellate stage, rather than before the lower instance, effectively allowing the appellant to prevail on this point of procedure. The court's ruling is grounded in Article 4 of the Law on Administrative Litigation No. 554/2004 and Article 521(3) of the Code of Civil Procedure, which governs the binding nature of such preliminary decisions.
