The High Court of Cassation and Justice admitted the preliminary reference and established that an individual dismissal decision can be validly communicated via electronic mail, thereby triggering the jurisdictional contestation deadline, provided the employee shared their email contact details and such a method constituted a customary practice between the parties; the Court ruled in favor of the legal position that electronic communication suffices for procedural validity, rejecting stricter formal requirements imposed by the Law on Electronic Signatures (no. 455/2001), and mandated that lower courts apply this interpretation. The dispute concerned the procedural validity of a labor dismissal decision sent by email in a labor litigation case, specifically whether such delivery met the legal standards for commencing the statute of limitations for appeal. The decisive legal basis was the interpretation of Article 77 and Article 278(1) of the Labor Code, in conjunction with Article 1326 of the Civil Code, Articles 211(1)(a) and 216 of Law no. 62/2011, and Article 184(1) of the Code of Civil Procedure, which collectively confirm that email communication in accessible PDF format is a valid procedural means of notification under the specified conditions.
