The High Court of Cassation and Justice admitted the referral from the Craiova Court of Appeal and issued a preliminary ruling, holding that staff paid under the normative acts listed in Article 1 of Law No. 124/2014 are exempted from the obligation to repay salary-related income received without legal basis up to the law's entry into force on 27 September 2014. The dispute concerned the interpretation of Articles 1(a), 2(1), and 3 of that law, specifically whether the exemption from restitution applied to sums unduly received before the law took effect. The Court decisively interpreted these provisions as granting the exemption for all such sums received prior to that date, and the ruling is binding pursuant to Article 521(3) of the Civil Procedure Code.
