The High Court of Cassation and Justice, in its Plenum formation for the resolution of legal issues, upheld the referral and established a mandatory interpretation regarding the remuneration of primary school teachers. The dispute concerned whether physical education classes delivered by primary school educators (including teachers of primary education) constitute part of their standard didactic norm or require separate hourly compensation. Relying on a comprehensive analysis of Law No. 1/2011 and specific Ministry of Education orders (Nos. 5560/2011, 6239/2012, 5451/2013, and 4895/2014), the Court ruled that such physical education hours are not included in the didactic norm and must be paid separately on an hourly basis. This decision, issued in a public hearing, is obligatory for all civil courts under the Code of Civil Procedure, effectively prevailing in favor of the position that these teaching activities warrant distinct compensation.
