The Supreme Court of Cassation and Justice took act of the appellant's renunciation of the judgment of the appeal, thereby leaving the lower court's decision in force as final and irrevocable. The case involved a civil appeal against a judgment from the Bucharest Court of Appeal, Section VIII of Administrative and Fiscal Contentious, which had previously dismissed the plaintiff's claim against the defendant; however, the substantive dispute was not re-adjudicated at the supreme level due to the procedural withdrawal. The decisive legal basis was Article 246 of the Civil Procedure Code, which governs the renunciation of the appeal and allows the court to take act of this procedural act without issuing a substantive ruling on the merits.

Decizia nr. 385/2014

Asupra recursului de faţă;
