The High Court of Cassation and Justice confirmed that the petition for review is perempted, thereby upholding the final decision of the April 17, 2013, which had previously dismissed the plaintiff's action as unfounded. The case involved a petition for review filed by a company under judicial administration against a prior cassation decision that had rejected its administrative dispute claim; the underlying legal action had remained in a state of inactivity for one year following a procedural suspension due to the unjustified absence of the parties. Applying Articles 248, 249–251, and 252 of the Code of Civil Procedure, the court determined that no procedural acts capable of interrupting or suspending the deadline occurred during the year of inactivity, resulting in the automatic peremption of the review petition.

Decizia nr. 1967/2015

252 alin. (1) C. proc. civ. şi va constata perimată cererea de revizuire.
