Suspension of statute of limitations for compensation claims on abutively expropriated properties by subsequent emergency orders
Legislator summary
AI generatedThe High Court of Cassation and Justice ruled in favor of the legal position that the three-year deadline for requesting compensation under Article 181(4) of Law No. 247/2005 was not extended or suspended by subsequent emergency orders, thereby affirming the strict application of the statute of limitations in cases involving abuses of the communist era. The dispute arose from a referral by the Craiova Court of Appeal regarding whether the application of the three-year deadline for claims related to abutively expropriated properties was affected by the suspending provisions of Emergency Order No. 62/2010 and Emergency Order No. 4/2012, which sought to modify the procedural framework for compensation claims between March 1945 and December 1989. The court established that Article 181(4) of Law No. 247/2005 remains intact and unaffected by Article III of Emergency Order No. 62/2010 and the sole article of Emergency Order No. 4/2012, mandating that the original limitation period governs the filing of such compensation claims. This decision is mandatory for all courts, ensuring that the temporal restrictions for legal recourse in property restitution and compensation matters are not retroactively altered by later emergency legislation.
