The High Court of Cassation and Justice, in its Complete Formation for Resolving Issues of Law, dismissed as inadmissible the connected preliminary reference questions submitted by the Court of Appeal regarding the interpretation and application of specific labor law provisions. The dispute involved a request to clarify the interplay between Government Decision No. 679/2003, Article 10(1)(f), and Labor Code Law No. 272/2004, Article 122(3)(d), in relation to Articles 1(2), 144, 149, and 253 of the Labor Code. The decisive legal basis was the procedural inadmissibility of the appeals under Article 521(3) of the Civil Procedure Code, resulting in no resolution of the underlying legal interpretation and leaving the reference questions unanswered by the supreme court.
