The High Court of Cassation and Justice (Înalta Curte de Casaţie şi Justiţie), sitting as a panel for the resolution of questions of law, dismissed as inadmissible the referral from the Oradea Court of Appeal (Section I civil) concerning a preliminary ruling on the interpretation of art. 832(1) of Law No. 303/2004 on the status of judges and prosecutors. The prior ruling remains in force. The dispute arose in a civil case (No. 936/108/2015) where the appellate court sought clarification on the application of this statutory provision, likely involving judicial or prosecutorial status matters. The decisive basis was the inadmissibility of the referral, meaning the procedural conditions for a preliminary ruling under the relevant provisions (art. 521(3) of the Civil Procedure Code) were not met. The decision is binding, and no substantive interpretation of the statute was provided.
