Prefect's right to judicially challenge local council's refusal to record premature cessation of councillor's mandate
Legislator summary
AI generatedThe High Court of Cassation and Justice, in its capacity for resolving issues of law, partially admitted the referral from the Timișoara Court of Appeal and established a mandatory legal interpretation, thereby ruling in favor of the prefect's right to judicial challenge regarding local administrative oversight. The dispute concerned whether the prefect could file an administrative lawsuit against a local council's refusal to formally record the premature cessation of a local councillor's mandate, a refusal allegedly based on the prefect's executive request under specific institutional powers. The court held that the "administrative oversight" provision in Law No. 554/2004 must be interpreted to confirm that the prefect is entitled to attack such a refusal—which is assimilated to an administrative act—before administrative courts, thereby validating the judicial mechanism for enforcing the prefect's attributes under Article 19(1)(a) and (e) of Law No. 340/2004 concerning the institution of the prefect.
