Legislator summary
AI generatedThe High Court of Cassation and Justice, sitting as the panel for resolving legal questions, issued a mandatory ruling admitting the referral from the Giurgiu District Court and establishing that Article 5(1) of Law No. 17/2014 applies to bilateral land sale agreements concerning agricultural lands in extravilan concluded before the law’s entry into force, regardless of when the court was seized. The dispute concerned whether the procedural requirements of Law No. 17/2014 could be enforced against pre-existing contracts for agricultural land sales. The Court determined that, based on Article 521(3) of the Code of Civil Procedure and the specific provisions of Articles 3, 4, and 9 of Law No. 17/2014, the trial court has the authority and obligation to order the completion of formalities, including obtaining necessary authorizations and observing the right of preemption, during the pending litigation to validate such contracts.
