Admissibility of court judgment substituting for authentic deed of sale of unregistered intravilan land
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling filed by the Vâlcea Court of Appeal, thereby leaving the lower courts to resolve the matter without a binding precedent from the highest instance. The dispute concerned the admissibility of a lawsuit seeking a court judgment to serve in lieu of an authentic deed of sale for intravilan land, specifically where the property subject to a bilateral promise of sale was not registered in the land cadastre. The court found the submission inadmissible in its review of the interplay between tax stamp obligations, cadastre registration requirements, and substantive civil law provisions, citing Article 57 of Emergency Governmental Ordinance No. 80/2013, Articles 35(1) and 36(2) of Law No. 7/1996, Article 2(1) of Law No. 17/2014, and Articles 885(1), 887(1), 1676, 1279(3), and 1669 of the Civil Code, while applying the mandatory nature of preliminary rulings under Article 521(3) of the Code of Civil Procedure.
