Applicability of civil tort provisions to labor disputes and revocability of termination decisions prior to communication
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the preliminary reference from the Court of Appeal and issued an obligatory decision binding all courts, establishing two key interpretations of the Labor Code: first, that civil code provisions on civil liability for torts are applicable in labor disputes to complement the Labor Code, and second, that an employer's decision to terminate a contract may be revoked up until the moment it is formally communicated to the employee, with the revocation subject to the same communication requirements as the original termination. The dispute arose from a labor litigation proceeding where the lower court sought clarification on whether civil liability norms could apply alongside specific labor laws and the procedural window for retracting a dismissal. The decisive legal basis consists of Article 278(1) of the Labor Code read in conjunction with Articles 1324, 1325, and 1326 of the Civil Code, as well as Articles 55(c) and 77 of the Labor Code, which define the grounds for termination and the definition of termination as an act requiring communication.
