The High Court of Cassation and Justice, sitting as the panel for resolving issues of law, admitted the connected referrals from the Court of Appeal and established two binding legal interpretations: first, that an audit decision by the Audit Court declaring certain benefits under a collective labor agreement illegal does not automatically nullify those contract clauses if judicial nullity has not been formally declared; second, that nullity for non-compliance with negotiation procedures can be invoked by interested parties via action or defense, or raised ex officio by the court, throughout the agreement's existence. The dispute concerned the legal validity of specific salary clauses in a collective labor agreement for a public institution, challenged following an audit finding that the benefits were granted contrary to public sector salary legislation. The decisive legal basis involved the interpretation of Article 1, Article 21, and Article 26(h) of Law No. 94/1992, Articles 132, 138(5), 142, 148, 151, and 152 of Law No. 62/2011, and Articles 229(4), 254, and 268(1)(d) of the Labor Code, with the ruling issued mandatorily pursuant to Article 521(3) of the Code of Civil Procedure.
