The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling filed by the Constanța Court of Appeal, thereby leaving the lower court to resolve the matter without a supreme court directive. The dispute concerned whether, when merging a suspended sentence imposed under the new Penal Code for an offense committed under the 1969 Penal Code but still pending trial with a final sentence imposed under the new Penal Code for a concurrent offense also committed under the 1969 Code, the applicable sanctions for multiple offenses should be governed by the law in force at the time of the merger or at the time the facts occurred. The decisive legal basis involved the interpretation of Article 10 of Law No. 187/2012 in conjunction with Article 5 of the Penal Code regarding the application of the more lenient law in cases of intertemporal criminal law conflicts.
