Annulment of appeal for non-payment of judicial stamp in administrative tax litigation
Legislator summary
AI generatedThe High Court of Cassation and Justice annulled the appellant’s appeal for lack of judicial stamp, leaving the Court of Appeal’s judgment intact, which had previously dismissed the plaintiff’s claims as devoid of interest and unfounded. The dispute concerned a civil action for the annulment and delivery of acts, as well as damages, directed against former officials and a local council, where the appellate court had rejected the suit on both procedural and substantive grounds. Relying on Article 137 of the Civil Procedure Code regarding pre-analysis checks, and specifically applying Article 20(3) of Law No. 146/1997 and Article 9(2) of Emergency Ordinance No. 32/1995, the court determined that the appellant failed to meet the mandatory obligation to pay the required judicial fees, thereby rendering the appeal formally inadmissible.

Asupra recursului de faţă;
