Preliminary ruling referrals on Civil Procedure Code Article 856(3) inadmissible for failing statutory conditions
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the joined preliminary ruling referrals from the Bucharest Tribunal (Fifth Civil Section) seeking an interpretative ruling on Article 856(3) of the Civil Procedure Code; the dismissal means no ruling on the merits was issued and no interpretation was fixed. The referrals arose in two civil cases challenging the procedural application of that provision. The Court held the referrals inadmissible because they did not meet the statutory conditions for a preliminary ruling under Articles 519–521 of the Civil Procedure Code, which require that the legal issue be determinative of the pending disputes and that the referral be necessary for their resolution; the decision is binding under Article 521(3).
