Judicial power to classify special working conditions for pension eligibility when administrative re-evaluation procedures were not followed
Legislator summary
AI generatedIn a decision issued by the High Court of Cassation and Justice under its full bench for resolving questions of law, the Court admitted referrals from the Constanța Court of Appeal and established a binding interpretation regarding pension entitlements, effectively resolving the dispute by restricting judicial power in specific administrative contexts. The case concerned whether civil courts could independently assess and classify employment conditions as "special conditions" to award pensions under the Public Pension System Law when the employer had not undergone the mandatory administrative re-evaluation procedure. The decisive legal basis was the interpretation of Article 30(1)(e) of Law No. 263/2010 in conjunction with Government Decision No. 1284/2011, where the Court ruled that common-law courts are prohibited from conducting their own analysis of working conditions or classifying jobs as special if the employer has not followed the statutory re-evaluation procedure, there is no opinion from the specialized re-evaluation committee, and the employer is not listed in Annex No. 3 to Law No. 263/2010.
