Civil liability in negligent bodily harm: standing for family life damages and apportionment of fault by victim
Legislator summary
AI generatedThe High Court of Cassation and Justice (ICCJ), sitting as the Complete Panel for Resolving Legal Issues in Criminal Matters, admitted the referral from the Târgu Mureş Court of Appeal and issued a binding preliminary ruling that interpreted specific civil liability provisions within the context of a criminal case for negligent bodily harm. The core dispute concerned the scope of damages and the effect of victim's fault in a personal injury claim, specifically whether family and social life impairment could be claimed by parties other than the victim and how the perpetrator's liability adjusts when the victim contributes to the damage. The court established that, pursuant to Article 1391(1) of the Civil Code, only the victim who suffered the injury is entitled to compensation for the restriction of family and social life possibilities, while pursuant to Article 1371(1) of the Civil Code, the wrongdoer is liable only for the portion of the damage they caused if the victim contributed to its occurrence, aggravation, or failure to mitigate it through their own fault. This interpretation is mandatory from the date of its publication in the Official Gazette, thereby unifying the application of civil liability principles in such criminal proceedings nationwide.
