The court annulled the claimant's appeal as unfunded (netimbrat), leaving the lower court's judgment in force, which had rejected the claimant's action on the merits. The claimant had sued the data protection authority for failure to respond to a complaint about a bank allegedly disclosing personal data to a company group for illicit purposes, seeking moral damages. The appellate court based its decision on procedural grounds: under the applicable legislation (Law No. 146/1997 and Government Ordinance No. 32/1995), court fees and judicial stamps were mandatory for the appeal, and since the claimant failed to pay them despite being notified, the appeal was annulled pursuant to Article 20(3) of Law No. 146/1997 and Article 9 of O.G. No. 32/1995.

Asupra recursului de faţă;

11 alin.
