The High Court of Cassation and Justice declared the recusal request inadmissible and declined jurisdiction on the transfer request, effectively ruling in favor of the tribunal's procedural standing by referring the latter issue to the Bucharest Court of Appeal. The dispute involved a procedural challenge filed against the members of Panel 9 regarding a case pending before the Bucharest Sector 3 Court, where the applicant sought the recusal of the judges and the transfer of the case based on a legitimate suspicion. Applying Article 47(2) and (4) of the Civil Procedure Code, the court found the recusal inadmissible because the alleged grounds did not fall within the statutory categories of Articles 41 and 42; regarding the transfer, Articles 42(1), 24, 131, and 142 established that the Bucharest Court of Appeal was the competent body to resolve matters concerning courts within its jurisdiction, mandating the decline of jurisdiction in favor of that appellate court.
