The High Court of Cassation and Justice, sitting as the General Division for resolving legal issues, admitted the preliminary reference filed by the Oradea Court of Appeal and issued a binding interpretation, establishing that Article 99(6) of Law No. 188/1999 applies to both situations regulated by Article 99(1)(a) of the same statute. The dispute involved a question of public service status and civil procedure, specifically concerning the applicability of dismissal-related provisions to different scenarios of termination or change in status within the public sector. The decisive legal basis was the interpretation of Article 99 of Law No. 188/1999 (Public Service Statute), with the ruling issued as obligatory under Article 521(3) of the Code of Civil Procedure, thereby clarifying the scope of dismissal protections for public officials.
