Budgetary claims under insolvency: merits review reserved to specialized court
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the referral from the Alba Iulia Court of Appeal and, in a preliminary ruling for the uniform interpretation of law, held that under Articles 105(1)–(2) and 106 of Law No. 85/2014 on insolvency, the judicial administrator/liquidator has no authority to review on the merits budgetary claims established by enforceable titles when those claims are challenged within the legal deadline before the specialized court. The ruling is binding under Article 521(3) of the Civil Procedure Code, and the appeal court’s referral was thus resolved in favor of the specialized court’s exclusive competence over the merits of contested budgetary claims.
