The High Court of Cassation and Justice, sitting as the Full Panel for Resolving Questions of Law, issued a binding interpretation establishing that a statement of claim and the conventional representation of a legal person before courts cannot be effected through a legal entity mandatary, nor through a legal counselor or attorney of such an entity. This decision resolved a preliminary ruling request submitted by the Brașov Court of Appeal regarding the admissibility of procedural representation in civil litigation. The court determined that under Article 84(1) of the Code of Civil Procedure, a legal entity must act through a natural person authorized to represent it directly, and this representation cannot be further delegated to another legal entity or its in-house legal advisors, thereby invalidating such modes of procedural standing.
