The High Court of Cassation and Justice (ICCJ) admitted the referral from the Court of Appeal Craiova and issued a binding interpretation that defines "decisions of medical expertise bodies" under labor law as the specialist occupational medicine physician's fitness assessment, contained in the fitness sheet, whether unchallenged or final after challenge, issued by the legally competent entity. This decision resolved a procedural dispute regarding the interpretation of Article 61(c) of the Labor Code (Law No. 53/2003), specifically clarifying the legal nature and procedural requirements of medical unfitness certifications used in employment terminations. The operative outcome is the establishment of the authoritative definition of medical unfitness documents for labor litigation, grounded in Article 61(c) of the Labor Code and issued pursuant to Article 521(3) of the Code of Civil Procedure, thereby providing a uniform legal standard for assessing the validity of such medical determinations in employment disputes.
