The High Court of Cassation and Justice dismissed the referral for a preliminary ruling as inadmissible, meaning the requesting appellate court’s submission was rejected without the superior court addressing the substantive legal question. The dispute concerned the interpretation of Article 6 of the Code of Criminal Procedure regarding the *ne bis in idem* principle, specifically whether the phrase "previous final penal judgment" limited the prohibition against double jeopardy to criminal proceedings or extended to civil, fiscal, or contraventional decisions that European Court of Human Rights jurisprudence might characterize as penal. The decisive legal basis involved the procedural admissibility requirements for referring questions of law to the Complete for Resolving Legal Questions, where the court found the referral deficient without analyzing the scope of "penal judgment" under Article 4 of Protocol No. 7 to the European Convention on Human Rights.

ÎNALTA CURTE DE CASAŢIE ŞI JUSTIŢIE

COMPLETUL PENTRU DEZLEGAREA UNOR CHESTIUNI DE DREPT ÎN MATERIE PENALĂ

Minuta deciziei nr.8 Dosar nr. 558/1/2016

Şedinţa din data de 30 martie 2016

ÎN NUMELE LEGII

D E C I D E:
