The High Court of Cassation and Justice admitted the referrals and decisively ruled that the individual food allowance provided as meal vouchers to staff in publicly financed healthcare units is a substantive legal right rather than a mere expectancy, thereby resolving the jurisdictional dispute and establishing a binding interpretation for the referring courts of appeal. The case originated from a divergent jurisdictional conflict regarding the classification of meal vouchers under labor law, specifically whether they constituted an enforceable wage component or a contingent future benefit for employees in the public health sector. The Court relied on Article 23 of Emergency Ordinance No. 115/2004, as amended and completed by Law No. 125/2005, to determine the nature of this benefit, and issued its decision pursuant to Article 521(3) of the Civil Procedure Code, rendering the ruling mandatory for all lower courts in similar matters.
